The ex-lawyer for the former president has resigned as New Jersey's top federal prosecutor. This decision was prompted by a court battle that invalidated her legal standing to serve.
Attorney General's Statement
The head of the Justice Department, the Attorney General, confirmed Habba's resignation on Monday. In a statement that the appeals court finding made it "untenable" for the official to perform her duties.
"Do not interpret compliance for surrender," Habba stated. "This battle will now reach across the nation."
Court Ruling
Habba's exit was triggered by a judicial panel found that she had been unlawfully serving as US attorney. This judgment is expected to impact numerous criminal cases in New Jersey.
The judicial panel declared that a temporary posting that skirted Senate approval violated the Federal Vacancies Reform Act.

The Attorney General added that the former prosecutor will continue working within the DOJ as a high-level advisor. Habba plans to challenge the decision of the disqualification, with hopes of a different outcome.
Writing online, Bondi wrote that the judiciary "must not override the President's choice of lawyers responsible for performing the primary duty of the administration of prosecuting crime."
